The following Terms and Conditions of Sale, govern the offer and sale of products on fonsatti.net (also the “Website”). Please read these Terms and Conditions of Sale carefully before ordering any products.

Guaranteed handmade products:
The clothing and the accessories on sale on fonsatti.net are all handmade in Guatemala from different artisans, therefore they may have small imperfections as a typical characteristic from elaboration, and there is to note that no piece is identical to another, as they cannot be recreated to perfection. We wish you should know this by ordering any of our products.

Personal requests and special items:
Request for further information regarding personalized and special items can be made by sending an email to [email protected]. In addition, any items that we tailor for you have an extra waiting time of manufacturing (1-4 weeks after final designs).

1. COMPANY INFORMATION

This Website is managed and maintained by the individual enterprise of Alejandro Fonsatti (the “Seller”), with registered office in Italy.

2. OUR BUSINESS POLICY

2.1 The Seller offers products for sale on fonsatti.net and its e-commerce business services are available exclusively to its end users (the “Consumer”).
2.2 “Consumer” shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. Therefore if you are not a Consumer, you shall not buy any products on shopthestory.it.

3. HOW TO BUY ON FONSATTI.NET

3.1 To place an order for the purchase of one or more products on fonsatti.net, you must fill out the online order form that will automatically be delivered to the Seller.
3.2 An order shall be deemed to have been submitted when the Seller receives your order form electronically and the order informations have been verified as correct by the “Consumer”.
3.3 By submitting your order form for the purchase of products, you will be asked to confirm that you have carefully read the Terms and Conditions of Sale.
3.4 The order form will be filed in the Seller’s data base for the time required to process your order and as provided by law. You may access your order form by visiting the section “Orders”, in the “Account” area of the Website.
3.5 Before submitting the order form, you are asked to identify and correct possible input errors.
3.6 The Seller shall not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by email that the contract has not been in whole or in part executed specifying the reasons thereof, therefore if the order form has been sent and the price has been paid, the Seller will refund the amount paid for the unshipped items.
3.7 By submitting an order form, you unconditionally accept and undertake to observe the provisions of these Terms and Conditions of Sale as well as further conditions contained in the Terms and Conditions of Use and Privacy Policy of fonsatti.net. Should you not agree with certain provisions of these Terms and Conditions of Sale, the order form may not be submitted.
3.8 Upon submission of an order form, the Seller shall send you a purchase order receipt email, containing a summary of the information related to the order form, and a confirmation email once the order informations have been verified as correct.

4. REMARKS ON PRODUCTS AND PRICES

4.1 As stated, the clothing and the accessories on sale on fonsatti.net are all handmade, therefore they may have typical small imperfections as characteristic.
4.2 The main characteristics of products are described and shown on fonsatti.net on each product page. The colors on the products may not exactly correspond to the exact real ones due to the luminosity changes in electronic devices.
4.3 Prices are subject to change and will be as quoted on the order form. Therefore please check the final price of sale before submitting the relevant order form.

5. PAYMENTS

5.1 The payment of the product prices and relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form, providing that it must be made at the time the order form is submitted.
5.2 In case of payment by credit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to Paypal or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by the Seller except for performing the procedure relevant to your purchase or issuing refunds in the case of returns, in compliance with the exercise of your return right referred to in article 6 below, or for reporting cases of fraud to the competent authorities.

6. CONSUMER RIGHTS

6.1 Pursuant to Italian Government Act 21.2.2014 nr. 21, art. 52, you may withdraw from the contract with the Seller in relation to products purchased on fonsatti.net, without any penalty and without specifying the reason, by notifying the Seller in writing within fourteen (14) days, beginning with the day after you received the products, with the methods referred to in point n. 6.3. In this case you will receive a full refund of the price of the products except for shipping costs and import duties.
6.2 For this purpose you should return the products to the Seller within fourteen (14) working days from the date you received the item, in the same condition in which you received them, with the methods referred to in point n. 6.3.
6.3 To correctly return the products:
1. you should notify the Seller of your withdrawal from the purchase in writing within fourteen (14) working days beginning with the day after you received the products, by writing an email at [email protected]
2. the products should not have been used, worn, washed or damaged;
3. the identification tag should still be attached to the products;
4. the products should be returned in their original packaging;
5. the products should be delivered to the carrier within fourteen (14) days following the notification to the Seller.
6.4 If you withdraw from the contract fulfilling the above conditions, the Seller will process the refund due to you within thirty (30) days following the day on which he has received the returned product.

7. GOVERNING LAW

These Terms and Conditions of Sale are governed by Italian law and in particular by the Italian Government Acts 6.9.2005 nr. 206, 6.8.2015 nr. 130 and 15.1.2016 nr. 8.

8. AMENDMENTS AND UPDATES

The Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons at Seller’s discretion. The new Terms and Conditions of Sale shall be effective as of the date of publication on fonsatti.net.
